James Wheaton is a highly experienced attorney currently serving as Special Counsel to the Director of Enforcement at the U.S. Commodity Futures Trading Commission since January 2018, providing guidance on all aspects of the Division of Enforcement's work. Wheaton has extensive investigative experience, particularly in cryptocurrency and digital asset matters, market manipulation, and fraud cases, having played a pivotal role as lead attorney on cases resulting in over $170 million in penalties. Prior to this role, Wheaton worked as a Trial Attorney at the U.S. Department of Justice in 2017 and held senior positions at the Commodity Futures Trading Commission and prominent law firms such as Pillsbury Winthrop Shaw Pittman LLP and Paul, Weiss, Rifkind, Wharton & Garrison LLP. Wheaton earned a Doctor of Law degree from New York University School of Law and holds both a Master's and Bachelor's degree in History from Stanford University.

The mission of the CFTC is to protect market users and the public from fraud, manipulation, and abusive practices related to the sale of commodity and financial futures and options, and to foster open, competitive, and financially sound futures and option markets. In pursuit of its mission, the CFTC investigates and prosecutes commodities fraud, including foreign currency schemes, energy manipulation and hedge fund fraud, and works with other federal and state agencies to bring criminal and other actions. The CFTC also engages in public education and outreach by participating in consumer groups and issuing Consumer Advisories and other educational materials.
